Witness: George Kelly’s statements came off as odd following fatal shooting

The victim's jacket had evidence of blood, and Kelly's AK-47 was tested for fingerprints. The size of the backpack was also shown, which has been questioned whether Buitima was a migrant or a trafficker. The first day of testimony was focused on the location of the fatal shooting.

TUCSON, Ariz. (13 News) - Comments made by George Alan Kelly at the scene of Gabriel Cuen Buitimea’s shooting on Kelly’s ranch stood out to the sergeant who was there.

Kelly is charged with second-degree murder for Buitimea’s death on Jan. 30th, 2023.

In a Santa Cruz County courtroom on Thursday, April 4, Kelly’s boots, gloves, and jeans were brought out of their packaging and shown to the jury. An Arizona DPS forensic scientist testified that no blood was found on those items.

Buitimea’s jacket had evidence of blood and that was confirmed. Kelly’s AK-47 was also shown to the jury since it was tested for his fingerprints.

Santa Cruz County Sgt. Omar Rodriguez showed Buitimea’s backpack, which he had to cut the straps to remove from Buitimea’s body. The size of the pack has been in question, alluding to whether Buitimea was a migrant or a trafficker. No weapons or drugs were found inside.

Rodriguez said when Kelly first walked with him to Buitimea’s body, Kelly said that rigor was starting to set in. Rodriguez suggested that meant Kelly had touched the body.

Rodriguez also said Kelly noted the nature of the bullet wound.

“While examining the body I said it seems like an entry wound. He said something about having a medical background and saying the bullet went through the lung and heart,” Rodriguez said in court.

Rodriguez said the wound was consistent with a shot coming from the Kelly house. He will return to the stand Friday for cross-examination by the defense.
